GENERAL TERMS AND CONDITIONS of The Happiest Hour Europe (THHE UG)
- Scope and Fundamentals
1.1 These General Terms and Conditions (hereinafter "GTC") govern the contractual relationship between THHE UG (limited liability), [Your Address], Berlin (hereinafter "Seller") and the customers of our online shop for terpene beverages and related products.
1.2 Consumer within the meaning of these GTC is any natural person who concludes a legal transaction for a purpose that cannot be attributed to either their commercial or their independent professional activity.
1.3 Entrepreneur within the meaning of these GTC is a natural or legal person or a legally capable partnership who acts in the exercise of their commercial or independent professional activity when concluding the legal transaction.
- Contract conclusion
2.1 The product presentations in our online shop do not constitute a binding offer, but an invitation to order.
2.2 By clicking the "Order with obligation to pay" button, the customer makes a binding offer to purchase the goods in the shopping cart.
2.3 The contract is concluded by:
- Sending an order confirmation by email within 48 hours
- or by shipping the goods
- or by demand for payment
- Prices and payment terms
3.1 All prices are in euros including the statutory value-added tax.
3.2 In addition to the stated prices, shipping costs may apply. These will be shown separately during the ordering process.
3.3 For orders, we offer the following payment options:

- Other payment methods displayed in the shop

- Delivery and Shipping Conditions
4.1 Delivery is made within Germany and the EU to the delivery address specified by the customer.
4.2 Free Shipping:
- From €40 order value within Germany
- From €80 order value EU-wide
4.3 The regular shipping costs are transparently displayed during the ordering process.
4.4 The delivery time is usually 1-3 working days within Germany and 3-5 working days to other EU countries.
- Right of withdrawal
5.1 Consumers have a statutory right of withdrawal.
5.2 Cancellation Policy You have the right to cancel this contract within fourteen days without giving any reason. The cancellation period is fourteen days from the day you or a third party named by you took possession of the goods.

- Retention of title
6.1 The delivered goods remain the property of the seller until full payment is made.
6.2 For entrepreneurs, we retain ownership of the goods until all claims arising from the ongoing business relationship have been fully settled.
- Liability for defects and warranty
7.1 The statutory warranty rights apply.
7.2 For entrepreneurs, the warranty period for new goods is one year from the transfer of risk.
7.3 The warranty does not cover normal wear and tear or improper handling of the products.
- Promotional Vouchers
8.1 Promotional vouchers are vouchers that cannot be purchased but are issued as part of promotional campaigns.
8.2 Only one promotional voucher can be redeemed per order.
8.3 A cash payment is not possible.
- Gift vouchers
9.1 Gift vouchers can be purchased in the online shop.
9.2 The validity period is three years from the date of purchase.
9.3 Gift vouchers can be used for the entire product catalog.
- Data Protection
10.1 We collect and process your personal data exclusively within the framework of legal provisions.

- Applicable law and jurisdiction
11.1 The law of the Federal Republic of Germany applies, excluding the UN Sales Convention.
11.2 For consumers, this choice of law applies only to the extent that the protection granted is not withdrawn by mandatory provisions of the law of the state in which the consumer has their habitual residence.
11.3 If the customer is a merchant within the meaning of the Commercial Code, the exclusive place of jurisdiction for all disputes arising from the contractual relationship is Berlin.
- Alternative Dispute Resolution
12.1 The EU Commission provides a platform for out-of-court dispute resolution. This gives consumers the opportunity to resolve disputes initially without involving a court.
12.2 We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
- Severability Clause
13.1 Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall not be affected.
